Who provides Encalio

Encalio is owned and operated by Western Horizon Technologies, Inc.. Our mailing address is 542 FM 672, Lockhart, TX 78644. References to Encalio, we, us, or our mean Western Horizon Technologies, Inc..

Accounts and eligibility

You must be at least 18 years old and able to enter a binding agreement to create an organizer, vendor, or administrative account or buy through Encalio. You must provide accurate information, protect credentials and MFA devices, promptly update account information, and accept responsibility for activity under your account. Guest and attendee information may be managed by an authorized adult event organizer.

Organizer, attendee, and vendor responsibilities

Organizers are responsible for event details, guest communications, event access, ticket and RSVP settings, capacity, safety, and lawful operation. Vendors are independent businesses responsible for accurate identity, pricing, packages, availability, licenses, insurance statements, fulfillment, staff, taxes, and service terms. Attendees and buyers must provide accurate order and RSVP information and follow applicable event rules.

Marketplace role and independent providers

Encalio provides discovery, comparison, planning, communication, booking, ticketing, and payment tools. Except where Encalio expressly sells its own subscription or service, vendors and organizers independently provide and remain responsible for the underlying goods, services, events, statements, warranties, cancellations, and customer support. Encalio does not employ or control independent vendors and does not guarantee their performance.

Public-source and unclaimed listings

Encalio may create limited unclaimed business listings from lawfully available public sources and vendor-owned websites. A listing is not an endorsement. Authorized representatives may claim and correct a listing. Anyone may report inaccurate, duplicate, closed, or unwanted listings through the reporting workflow. Encalio may verify ownership before transferring control and may retain suppression records needed to avoid republishing or re-contacting a business.

Transparency requirements

Encalio is built around clear vendor pricing and terms. Hidden fees, misleading packages, bait-and-switch pricing, deceptive availability, unclear refund/cancellation terms, and abusive sales practices are not allowed.

Merchant of record and payment collection

For a booking, ticket, subscription, or add-on paid through Encalio checkout, Encalio is the merchant of record for payment processing and may appear on the card or bank statement. Encalio accepts the payment through Stripe, deducts disclosed Encalio and processor amounts, and may transfer eligible net proceeds to a connected vendor or organizer account. The vendor or organizer remains the underlying seller or service provider and is responsible for fulfillment, event operation, customer-facing policies, and amounts that Encalio must recover because of that transaction. Payments completed directly or through an external link are transactions between the buyer and the identified vendor or organizer; Encalio is not merchant of record for those payments.

Prices, fees, taxes, and payment authorization

Checkout must disclose the buyer total and applicable price, tax, ticketing fee, booking fee, revenue share, subscription, add-on, or paid placement charge before authorization. Standard ticket processing is 6% plus $0.30 for every ticket unless an approved account or event override is shown. Non-ticket Encalio-processed booking revenue uses the disclosed graduated 6%/5%/4% schedule plus $0.30 for every transaction, unless an approved override applies. You authorize Encalio and Stripe to charge the selected payment method and to use tokenized payment credentials for agreed recurring or scheduled charges. Vendors and organizers are responsible for taxes tied to their underlying sales unless Encalio is legally required to calculate, collect, or remit them.

Cancellations and refunds

Each vendor or organizer must publish an accurate cancellation and refund policy before accepting an order. Buyers should first submit refund requests through the applicable Encalio order, ticket, or support workflow. Encalio may process refunds approved by the responsible vendor or organizer, required by the disclosed policy, or required by law. A refund of the buyer charge does not automatically reverse a transfer already sent to a connected account. Encalio may reverse a transfer, reduce future payouts, place a reserve, invoice the responsible account, or use another disclosed recovery method. Whether Encalio or processor fees are returned depends on the applicable checkout terms, processor rules, and law.

Disputes, chargebacks, and fraud

Because Encalio-processed charges are created on Encalio’s payment account, Stripe may debit Encalio for disputed principal, processor fees, refunds, and chargebacks. The vendor or organizer responsible for the underlying transaction must provide timely evidence and reimburse Encalio for transaction amounts and processor dispute fees attributable to its sale, event, policy, fulfillment, fraud, or customer claim, except to the extent caused by Encalio’s error or prohibited by law. Recovery may use payout deduction, transfer reversal, reserve, invoice, saved payment method, or an admin-reviewed accounting adjustment.

Payout timing, reserves, and offsets

Net proceeds become eligible for connected-account transfer only after successful payment and the configured clearance period, normally no earlier than two days. Eligibility is not a guarantee of delivery on a particular date. Encalio or Stripe may delay, hold, reduce, reverse, or offset payouts for verification, insufficient available balance, refunds, disputes, chargeback exposure, fraud or policy review, legal process, sanctions, reserve requirements, processor restrictions, or account suspension. Vendors and organizers must maintain current Stripe Connect information and a valid payout method.

Subscriptions, add-ons, and renewal

Paid packages and recurring add-ons renew on the disclosed billing interval until canceled. The checkout or account billing page identifies price, renewal timing, included features, and any trial or grace period. Cancellation stops future renewal but does not undo services already delivered. Refund rights for subscription or add-on charges are governed by the purchase terms shown at checkout and applicable law. Failed recurring payments may be retried, may restrict paid features, and may result in downgrade or suspension after the disclosed recovery period.

Vendor terms and legal templates

Vendor terms, contract templates, refund policies, waivers, and planning guidance are operational starting points only and are not legal, tax, insurance, financial, or professional advice. Vendors and organizers are responsible for reviewing terms with qualified professionals before relying on them.

Messaging, invitations, SMS, MMS, and marketing

Encalio may send requested account, security, support, booking, ticket, and event messages. Commercial email identifies Encalio and includes a way to stop future marketing. Marketing SMS or MMS may be sent only where Encalio or the sending user has the consent or other legal basis required for that message. Users who upload contacts or send invitations, campaigns, or broadcasts represent that they have authority to use those contact details and must honor opt-outs. Message frequency varies; message and data rates may apply. Reply STOP to opt out, START to opt back in, or HELP for help where supported. Transactional messages requested by the recipient may still be sent after a marketing opt-out.

Sponsored placement and recommendations

Paid or sponsored placement must be labeled. Sponsorship may affect placement within designated sponsored inventory but does not guarantee leads, bookings, attendance, revenue, or organic ranking. Organic and personalized results may use relevance, location, availability, profile completeness, quality, and user preferences. Vendors and organizers may not buy or manipulate false reviews, engagement, or ranking signals.

Content, media, and intellectual property

You must own or have permission to upload, link, send, or publish content, images, videos, logos, reviews, event media, and vendor materials. You grant Encalio the rights needed to host, display, process, moderate, transmit, and operate that content within the service.

AI-assisted and automated features

AI and automation may prepare drafts, classifications, summaries, layouts, or recommendations. Outputs can be incomplete or wrong and must be reviewed by an authorized person before publication, outreach, contracting, payment, safety, capacity, or legal use. Encalio may impose limits, queue work, block unsafe instructions, and retain audit evidence. You may not use AI features to infringe rights, deceive others, bypass consent, or make unlawful automated decisions.

Venue maps, seating, capacity, and event safety

Venue maps, seating layouts, directions, capacity estimates, scanner tools, and AI-generated layouts are planning aids, not architectural, engineering, fire-code, accessibility, occupancy, or life-safety certifications. Venue operators and organizers must verify measurements, exits, aisles, accessibility, capacity, permits, and emergency plans with the property owner and qualified authorities before use.

Acceptable use

You may not harass, phish, spam, scrape private data, bypass consent controls, misuse invite or reach-back tools, upload malware, interfere with service operation, impersonate others, or use Encalio for illegal, unsafe, fraudulent, or abusive activity.

Moderation and enforcement

Encalio may review, refuse, remove, restrict, suspend, or terminate accounts, listings, events, messages, media, payments, or access for suspected fraud, abuse, safety concerns, legal compliance, chargeback risk, policy violations, or platform security.

Third-party services

Encalio may connect to payment processors, messaging providers, calendar services, map providers, printing partners, financing providers, and other third parties. Their terms and privacy practices may also apply.

Service disclaimers

To the fullest extent permitted by law, Encalio and all platform content are provided as is and as available. Encalio disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee vendor performance, event outcomes, listing accuracy, uninterrupted availability, message delivery, ticket resale value, or third-party behavior. Some jurisdictions do not allow certain disclaimers, so those limits may not apply to you.

Limitation of liability and indemnity

To the fullest extent permitted by law, Encalio is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, event interruption, or third-party acts. You agree to defend and indemnify Encalio from claims, losses, and reasonable costs arising from your content, event, listing, goods or services, messages, legal violations, fulfillment failures, taxes, refunds, disputes, or breach of these terms, except to the extent caused by Encalio’s own unlawful conduct.

Suspension and termination

You may stop using Encalio and may cancel eligible subscriptions through account billing. Encalio may suspend or terminate access as described above. Termination does not eliminate accrued payment, refund, chargeback, tax, confidentiality, record-retention, indemnity, or dispute obligations. We may preserve or remove data according to the Privacy Policy, legal duties, backup cycles, and operational needs.

Governing law and disputes

These terms are governed by the laws of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes that cannot be resolved through support must be brought in the state or federal courts serving Caldwell County, Texas.

Changes and contact

We may update these terms as the service evolves. Material changes will be posted with a new effective date and may also be communicated to account holders when appropriate.
